By accessing and using Bill Zap (the "Service") at billzap.com.au, you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Bill Zap, an Australian-operated electricity bill comparison service.

Bill Zap provides a free electricity bill comparison service that:

  • Analyses uploaded electricity bills using OCR and AI technology
  • Compares your electricity rates with market data and anonymous user data
  • Provides personalised recommendations for potential savings
  • Offers optional email notifications about better electricity deals

Important: Bill Zap is a comparison and information service only. We do not sell electricity, act as an energy retailer, or facilitate switching between providers.

3. User Responsibilities

3.1 Accurate Information

You agree to:

  • Upload only your own electricity bills or bills you are authorised to share
  • Ensure uploaded bills are genuine and unmodified
  • Provide accurate email addresses if subscribing to notifications
  • Use the Service for personal, non-commercial purposes only

3.2 Prohibited Uses

You must not:

  • Upload bills belonging to other people without permission
  • Attempt to reverse-engineer our comparison algorithms
  • Use automated tools to scrape or harvest data from our Service
  • Upload malicious files or attempt to compromise our systems
  • Use the Service for any illegal or unauthorised purpose

4. Service Availability and Modifications

4.1 Service Availability

We strive to maintain Service availability but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance
  • Technical issues
  • Third-party service dependencies
  • Circumstances beyond our reasonable control

4.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice. We may also update these Terms as needed.

  • Savings estimates will be precisely achievable
  • All available plans in your area will be included

Our Service provides general information and comparisons only. We do not provide:

  • Personal financial advice
  • Recommendations to switch specific providers
  • Guarantees about future savings
  • Professional energy consulting services

You should conduct your own research and consider your specific circumstances before making energy provider decisions.

6. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your information is governed by our Privacy Policy, which forms part of these Terms.

Key privacy commitments:

  • Personal information is automatically removed from uploaded bills
  • Only anonymous, aggregated data is retained
  • Original bill files are deleted within 24 hours
  • Email addresses are stored separately and only used for opted-in notifications

7. Intellectual Property

7.1 Our Content

All content on the Service, including text, graphics, logos, software, and algorithms, is owned by Bill Zap or our licensors and protected by Australian and international intellectual property laws.

7.2 Your Content

By uploading bills, you grant us a limited, non-exclusive licence to process and analyse the content solely for providing our Service. This licence terminates when we delete your uploaded files.

8. Disclaimers and Limitation of Liability

8.1 Service Disclaimers

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, completeness, or reliability of information, especially information generated by AI
  • Uninterrupted or error-free operation
  • Security or privacy of transmitted data

8.2 Limitation of Liability

To the maximum extent permitted by Australian law, Bill Zap will not be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages exceeding $100 AUD in total

This limitation applies regardless of the legal theory and even if we have been advised of the possibility of such damages.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Competition and Consumer Act 2010 (Cth) or other applicable Australian consumer protection laws that cannot be excluded, restricted, or modified by agreement.

Where we are permitted to limit our liability, our liability is limited to resupplying the Service or paying the cost of resupplying the Service.

You agree to indemnify and hold harmless Bill Zap from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your uploading of bills without proper authorisation
  • Your misuse of the Service
  • Your violation of any third-party rights

11. Termination

We may terminate or suspend your access to the Service at any time for violation of these Terms or for any other reason. You may stop using the Service at any time.

Upon termination:

  • Your right to use the Service ceases immediately
  • We will delete any remaining personal information
  • Anonymous data may be retained for service improvement

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.

12.2 Dispute Resolution

Before commencing legal proceedings, we encourage you to contact us to resolve any disputes. If a dispute cannot be resolved through direct communication, it may be referred to mediation.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Bill Zap regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.

13.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

13.5 AI by Design

Content that is generated by AI is not intended to be a substitute for professional advice and accuracy is not guaranteed.
